Terms and Conditions for Evolutia Digital LLC Hosting Service

1. Introduction

These Terms and Conditions govern the provision of hosting services ("Services") by Evolutia Digital LLC ("Company") to the customer ("Customer"). By registering for and using our hosting services, you agree to be bound by these terms and conditions.

2. Service Description

Hosting Package:

  • 10 GB of disk space for the website.
  • 10 email accounts with 15 GB of space each, SpamAssassin spam filter, and Roundcube webmail.
  • 1 domain (.es, .com, .org, or .net) included; additional TLDs available at extra cost.
  • User-managed hosting via Plesk panel accessible at https://panel.evolutia.digital. Credentials provided upon registration.

Plesk Panel Features:

  1. Free SSL certificates from Let's Encrypt, with support for private certificates.
  2. Support for PHP, MySQL, and PostgreSQL. Includes 1 MySQL database.
  3. FTP access for file transfers and web environment.
  4. Enhanced security with hardware firewall, OWASP web filter rules, IP restrictions via Fail2ban, and DDOS attack prevention.
  5. Servers located in the EU, compliant with GDPR.
  6. Daily backups.

3. Pricing and Payment

  • The annual cost of the hosting service is €82.
  • Prices are subject to change due to increased service costs. Customers will be notified of any price changes before the renewal for the subsequent year.

4. Technical Support

  • Technical support is available via email at info@evolutia.digital or WhatsApp at +44 745 814 9498.
  • Support is provided in English and Spanish.
  • Support hours are Monday to Friday, 09:00 to 18:00, excluding public holidays on December 25 and January 1.

5. Customer Responsibilities

  • Customers are responsible for maintaining the security and confidentiality of their Plesk panel login credentials.
  • Customers must ensure that their use of the Services complies with all applicable laws and regulations.
  • Customers are responsible for the content they upload and manage on their hosting accounts.

6. Company Responsibilities

  • The Company shall provide the Services with reasonable skill and care.
  • The Company shall ensure the availability of the Services, except during scheduled maintenance or circumstances beyond the Company’s control.
  • The Company shall notify the Customer of any scheduled maintenance or changes to the Services.

7. Service Suspension and Termination

  • The Company reserves the right to suspend or terminate the Services if the Customer breaches these Terms and Conditions.
  • The Customer may terminate the Services at any time by providing written notice to the Company. No refunds will be issued for the remaining period of the subscription.

8. Limitation of Liability

  • The Company shall not be liable for any indirect, incidental, or consequential damages arising out of or related to the use of the Services.
  • The Company’s total liability under these Terms and Conditions shall not exceed the amount paid by the Customer for the Services during the twelve (12) months preceding the claim.

9. Changes to Terms and Conditions

  • The Company reserves the right to modify these Terms and Conditions at any time. Changes will be effective upon posting on the Company’s website. The Customer’s continued use of the Services constitutes acceptance of the modified Terms and Conditions.

10. Governing Law

  • These Terms and Conditions shall be governed by and construed in accordance with the laws of the state of Delaware, United States of America.
